As part of CPP, TM is conducting a democracy survey to contribute to the promotion of democracy, promote a clearer  understanding of democracy and provide a platform for dialogue. This survey will provide reliable benchmark data against which the progress of the Maldivian transition to democracy might be measured in the future.

Work is underway to compile and publish the findings of the Democracy Survey 2015. We are seeking the services of a consultant to translate the Democracy Survey report from English to Dhivehi.

III. Key Responsibilities

  1. Translate the Democracy Survey 2015 (approximately 100 pages of text), from English to Dhivehi, including captions, charts, graphs and infographics
  2. Provide the translated documents in Microsoft Word format.

IV. Deliverables

Transparency Maldives in partnership with the International Foundation for Electoral Systems (IFES) is conducting Democracy Camp 2 from 29th August – 04th September 2015. The 6-day camp will be held at a Kaafu Girifushi.

The primary goal of the camp is to enhance the participants’ knowledge on civic education, rights and responsibilities of a citizen, democracy, human rights and various social issues. The camp will aim to provide participants with the knowledge and tools to actively engage in community initiatives and encourage responsible citizenship and civic engagement.

Under TMs “Promoting transparency and accountability through right to information” project funded by the Friedrich-Naumann-Stiftung für die Freiheit, TM aims to undertake further advocacy, training and lobbying to support the successful implementation of the Right to Information Act.

2. Background to the assignment.

One of the key areas of TMs work is focused on promoting access to information for increased transparency and accountability in order to build public confidence in institutions and pillars of the state. We work to empower people to utilize access to information as a tool to eliminate corruption in day-to-day life by creating a strong access to information regime. In the past, TM has worked under different projects, advocating for a best practice Right to Information (RTI) Act that was passed in December 2013 and ratified in January 2014, and training stakeholders across the country to increase awareness on the processes for implementing the legislation. Building on this, TM plans to review and provide recommendations on the new RTI Regulation.

3. Purpose of the Assignment

TM is seeking the services of a consultant to conduct a comprehensive review of the Maldives RTI Regulation through a consultative process to improve the Regulation based on the existing RTI Act, and produce a revised draft of the RTI Regulation. The consultant will work closely with TM and relevant authorities throughout the assignment.

4. Responsibilities of the consultant

  • Review of international, regional RTI Acts, Guidelines and Regulations, in particular from areas of strong access to information regimes and compare with the Maldives RTI Regulation.
  • Explore possible improvements, to the Maldives RTI Regulation taking on board progressive modalities of RTI Regulations and Guidelines.
  • Conduct consultations with national stakeholders, in particular the Information Commissioner’s Office and relevant partners of TM.
  • Make recommendations to strengthen the Regulation, adopting international and regional standards with specific considerations of national processes and structures.

5. Duration of the Assignment: 25 days, with expected start date in 16 July 2015. The consultant is expected to be in Malé, Maldives for the duration of the assignment.

We write this petition to request you to declare and publicly disclose your assets in order to enhance transparency and integrity of public officials, and to increase public trust in the state and oversight bodies. We believe asset declarations are crucial in ensuring that personal interests of public officials do not conflict with their duties and responsibilities. Asset declarations also help to identify cases of illicit enrichment, so that a public official may legitimately be held accountable. Therefore, we call on you to declare your assets in accordance with the law, and to disclose your assets by publishing on the website of your respective offices.

Why this is important

Asset declaration requires a certain category of public officials––also identified as “politically exposed persons” to describe individuals entrusted with prominent public functions––to disclose their financial and business interests. The principle goal of asset declaration is to combat corruption––in particular, illicit enrichment––and promote transparency and accountability of the governance system.

The Maldivian Constitution requires the President, Cabinet Ministers, Members of the Parliament, and Judges to annually submit their financial and business interests. Members of constitutional bodies such as the Anti-Corruption Commission, Judicial Service Commission and Elections Commission are also required to submit their asset declaration documents. However, there is no legal provision for the following officials to submit their declarations:

  • Vice President
  • Auditor General
  • Information Commissioner
  • Members of other constitutional bodies such as Human Rights Commission of the Maldives and Civil Service Commission
  • Members of institutions such as Maldives Media Council, Maldives Broadcasting Commission, Police Integrity Commission, and Customs Integrity Commission
  • Officials of state-owned enterprises

While this is one key weakness of the current asset declaration regime, other key weaknesses include lack of accountability and lack of transparency.

Despite the constitutional provisions that mandate some public officials to declare their assets, there are no punitive measures legally prescribed to those who violate this provision. This lack of accountability puts these public officials above the law and encourages a culture of impunity to thrive unchecked. While some officials submit the documents regularly, others do not submit at all, thus rendering the system ineffective.

Furthermore, the main objective of asset declaration is to enhance transparency and integrity of public officials and restore the trust of citizens in the government and oversight bodies. The fulfilment of this objective, however, is currently impossible since the declared information is not made available to the public. Public disclosure gives the media, civil society groups, and the wider public an increased role in holding public officials to account.

2. Assignment background

In 2014, Transparency Maldives published the National Integrity System (NIS) assessment report. The report describes the status of the 12 pillars of the Maldivian National Integrity System in terms of their capacity, governance, and specific roles in fighting corruption. These aspects are analysed in relation to the strength of the Maldivian legal framework and the institutional practices in place in the country.

The results of the NIS assessment shows the striking difference between the theoretical legal framework and the practical application of law in the Maldives and highlights the overall weak efforts of all institutions in fulfilling their role to fight corruption. The NIS assessment approach used in this report provides a framework to analyse both the vulnerabilities of a given country to corruption and effectiveness of national anti-corruption efforts.

Transparency Maldives is currently running a project focused on connecting the NIS assessment outcomes with advocacy and policy reform initiatives. The two main objectives of this advocacy efforts are: 1) raising awareness among institutions on asset declaration and increase public pressure for asset declaration; 2) capacity build media and increase media role in addressing corruption.

TM received formal government registration in 2007, and is the National Contact of Transparency International (TI) in the Maldives.

Following the Civic Participation Project (CPP) undertaken from December 2014 – September 2015, TM is currently implementing a program, built on the foundations, recommendations and lessons learned from the CPP in 2013/2014. TM’s domestic election observation effort, its community engagements across all 20 atolls, research and awareness raising programs during the 2013/2014 electoral cycle of the Maldives provided key focus areas to design TM’s interventions in the coming years. The activities of this project are based on these premises. The main goal of this program is to support the democratisation process in the Maldives by promoting citizens’ awareness and participation in the democratic process, specifically among youth and women.

2. Purpose of the Assignment
TM recognises the importance of civic education for school children and young persons to equip them with the knowledge and tools to contribute towards a democratic, just and corruption-free society. To this end, TM wishes to support the roll out of the new civic education curriculum by increasing the knowledge and skills of teachers on civics. To achieve this, TM plans to conduct a training program for teachers, in partnership with the National Institute of Education (NIE).

TM is seeking the services of a Consultant to develop a two-day training program for teachers. The Consultant will review the new civic education curriculum and conduct a needs assessment, based on the findings of which the training will be developed.

3. Responsibilities of the consultant
The Consultant will be expected to:
a — Review the national civic education curriculum and conduct interviews with the relevant stakeholders and institutions to identify specific training areas and need,
b — Design and develop trainings modules,
c — Develop an assessment tool to be administered both at the beginning and end of the workshops in order measure any change in knowledge and perception of participants,
d — Conduct a Training of Trainers (ToT),
e — Gather feedback from the participants of the ToT and finalise training modules,
f — Deliver final assessment and analysis, and training modules along with user guidelines of the modules,
g — Deliver training sessions to teachers along with other master trainers.

4. Competencies

Required
1. Bachelor’s degree in teaching, education or social sciences.
2. Ability to research, analyse and synthesise information.
3. Ability to clearly and concisely express ideas and concepts in written and oral form.
4. Experience in developing training programmes for adults.
5. Excellent spoken and written English and Dhivehi.
6. Excellent translation skills from Dhivehi to English and vice versa.
7. Knowledge of critical civic education areas in the local context.
8. Good interpersonal skills and ability to set priorities and manage time.

1. Organization Background
Transparency Maldives (TM) is a non-profit, non-partisan organization that endeavours to be a constructive force in society by promoting collaboration and discussion on corruption, transparency and accountability. Our organization seeks to engage with stakeholders from all sectors (government, business, politics and civil society, among others) to raise awareness of corruption’s detrimental effects on development and society, improve transparency and accountability in governance, and eliminate corruption from the daily lives of people.

Under TMs “Promoting transparency and accountability through right to information” project funded by the Friedrich-Naumann-Stiftung für die Freiheit, TM aims to undertake further advocacy, training and lobbying to support the successful implementation of the Right to Information Act.

2. Background to the assignment.
One of the key areas of TM’s work is focused on promoting access to information for increased transparency and accountability in order to build public confidence in institutions and pillars of the state. We work to empower people to utilize access to information as a tool to eliminate corruption in day-to-day life by creating a strong access to information regime. In the past, TM has worked under different projects, advocating for a best practice Right to Information (RTI) Act that was passed in December 2013 and ratified in January 2014, and training stakeholders across the country to increase awareness on the processes for implementing the legislation. Building on this, TM plans to review and provide recommendations on the new RTI Regulation.

3. Deliverables

  • A 5-page inception report highlighting the methodology and review materials including all reference and research Regulations, Guidelines, any other documents, identified stakeholders and a timeline of activities within 7 days of signing the agreement.
  • A draft report of the consultation outcomes identifying key issues highlighted during the consultation meetings.
  • A final report of the review assessment and proposed recommendations on the Maldives RTI Regulation.
  • A final draft of a revised RTI Regulation.

4. Duration of the Assignment: 25 days, with expected start date in 27 May 2015. The consultant is expected to be in Malé, Maldives for the duration of the assignment.

5. Competencies

  • Bachelor’s degree in Law, preferably with a Postgraduate/Master’s qualification.
  • Ability to research, analyze and synthesize policies and regulations
  • Ability to clearly and concisely express ideas and concepts in written and oral form.
  • Excellent spoken and written English and Dhivehi.
  • Excellent translation skills from Dhivehi to English and vice versa.
